Acceptance of Terms

By downloading, installing, or using Nowly (the browser extension, native application, website, and any associated software), you agree to these Terms of Service. If you do not agree, please do not use the software.

Service Description

Nowly is an open-source tool that detects media content in your browser and automatically updates your Discord status (Rich Presence) via local communication with the Discord client. The service consists of:

A Chromium browser extension that detects and reports your activity.
A Windows native application that acts as a gateway to Discord.
A website (marketplace) for discovering and installing presences.
A developer SDK and tooling for creating custom presences.

License

Nowly is distributed as open-source software. You are permitted to use, copy, modify, and redistribute it in accordance with the applicable license (available in the GitHub repository). This license does not apply to content from third-party platforms (YouTube, Twitch, etc.) that you choose to display via Nowly.

Responsible Use

You agree to use Nowly in compliance with applicable laws and Discord's Terms of Service. Specifically, you must not:

Use Nowly to display illegal, hateful, or inappropriate content.
Attempt to bypass the security mechanisms of the extension or native application.
Distribute modified or unsigned presences through the official infrastructure.
Use Nowly in a way that violates the terms of service of Discord or any streaming platform you access.

Intellectual Property

The Nowly source code is subject to its applicable open-source license. All third-party trademarks, logos, and platform names (YouTube, Twitch, Disney+, Apple TV+, Prime Video, Discord) remain the property of their respective owners. Nowly is not affiliated with, endorsed, or sponsored by Discord Inc. or any of the supported streaming platforms.

Limitation of Liability

Nowly is provided "as is", without any warranty, express or implied. The author shall not be held liable for any direct or indirect damages arising from the use or inability to use the software, including but not limited to:

Malfunction of Discord or your status display.
Suspension or restriction of your Discord account by Discord Inc.
Loss of data stored locally by the extension.
Any indirect damage related to the use of the native application.

Privacy

Your use of Nowly is governed by our Privacy Policy, which is incorporated into these Terms of Service. We encourage you to read it carefully before using the service.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes take effect immediately upon publication on this page. It is your responsibility to review this page periodically. Continued use of Nowly after changes are posted constitutes your acceptance of the new terms.
